Statute of limitations in New Hampshire

Postby kracken on August 1st, 2008, 9:52 pm

I have been contacted by a law firm in FL (where I reside) concerning a credit card balance from a credit card that was issued in NH (where I lived until 4/06) and have not paid on since March 05 and received not correspondence since about 6/05.. We tried to work out arrangements at that time but they wanted a large payment and we couldn't pay as many as we wanted if one was going to get all the money. About three weeks ago I was informed that I had to pay the past due balance (about 1666.00) in two payments (one this month on the 23rd) and one next month on the same date in order not to be taken to court. I read on a web page that the statue of limitation is 3 years in NH. Is that the state whose limitations govern the debt?
Are they past the statue of limitations to pursue this debt?

I really can't afford to pay it but they said my wages would be garnished after the court awarded a judgement so I felt I better do something.....

The statute should fall under NH but there may be an exception in your card holder agreement. If it is NH than the statute would begin the last time you made a payment or had activity, whichever came later. If 3 years has passed, they can still attempt to sue you. Fortunately, the burden of proof is on their shoulders. You can send a validation letter to them demanding proof of the liability. If done correctly, it can in many cases get them off your back. It also serves as documentation should they ever take you to court.
