Statute of Limitations for Wage Garnishment

Postby Guest on August 26th, 2008, 6:57 pm

Hi, my name is Allan and I have question concerning a letter I recieved from a debt collector. The account was a credit card that was included in a bankruptcy. The bankruptcy was dismissed in November of 2007. It was dismissed before any payments were made to this company. The whole ordeal is now almost eight years old. My question is can they put a judgement on my property or garnish my wages after that amount of time? I read the online information concerning this and I'm not 100% sure I understand the laws. Your help would be greatly appreciated.

Thanks,

Allan.

P.S. I'm located in Virginia.

They can only garnish your wages or place a lien on property if they obtain a judgment. The amount of time they have to collect depends on several variables. 1) Type of debt and 2) the state you lived in when the account was opened. The date of last activity is when the time clock started ticking. Based on that you can look up the statute on my website: http://www.expert-credit-advice.com/sta ... ations.htm
