Remove Inaccurate Late Payments from Equifax, TU and Exp..

Dear Expert Advice, I am currently paying a 60 month car loan via Infiniti Financial Services. On October 19, 2007, I requested from Infiniti a month extension for my October 31, 2007 car payment. The extension was granted for two months, starting in October and ending in December, 2007. Meaning, I would have to pay the December 21, 2007 note. I received the extension form in the mail on October 31, 2007. The form clearly stated that it must be sent back prior to December 13, 2007. The form was sent back and received by Infiniti on December 1, 2007.The issue is, I have a late payment on my credit report for October, 2007. The statement lowered my FICO score by 60 points. I have tried via Equifax, Experian, etc. to get this remove to no avail. I have completed extension with Infiniti in the far past and never ran into this issue. Infiniti refuses to update my report to show that I was NEVER late paying my car note. I have even offered to rescend the extensions and pay the car payments but was told that my extension was granted but I sent in the form too late which absolutely makes no sense, since the form was received by Infiniti prior to the due date located on the extension form.Spoke with an attorney about this item. I was informed that since no harm was done to me (lower FICO score does not constitute harm) that there was nothing that can be done. I also also sent letters to the Attorney's Office where Infiniti Financial Services is headquarters. Have not heard from them yet.Please advise..

In understand your situation and unfortunately there are only two ways to remove the late payment, 1) challenge with the credit bureau 2) request the creditor to delete it. You have already tried both and have not been successful. I recommend challenging the late payment in writing with both the creditor and the 3 credit bureaus and don’t give up until you are satisfied. Demand removal based on facts and evidence. Document all correspondence and always send certified mail with domestic return receipt. If you are not satisfied, you can always sue under the FCRA and possibly the FCBA. The fact that you have the extension paperwork should help, but there are never any guarantees. You may be able to find an attorney that will work the case.
