Pogo Stick Broke

My 13 year old son was using the pogo when the weld broke and he fell face first into cement. It caused major damage to his teeth. He has had about 5,000 in bills and much more needs to be done. I was wondering do I hire a lawyer or can I fight this myself? The insurance company sent out an adjuster and they did claim that it was an defective product. Does this mean they will pay for all bills past and future?
