Old Bad Check - Judgment Liability

I worked for a company in Utah in 1998 and they ended up going bankrupt and the last payroll check they issued to me and others[ for work performed] was cashed by us and the check went to a collection agency for NSF and rather than going after the Company which was from Idaho the collection agency got a judgment on me to collect the amount of the check plus a whole lot more. Can you tell me what I might be able to do I did not write the check. Thanks I am doing a little research and Im sure I shouldnt be liable for this check.

That is very unfortunate and a very good question. I hope I am understanding exactly what you are asking. If the employer wrote you a check and it wasn’t paid, you never received the money so how is a debt owed? Did your bank honor the check? You say they have a judgment against you, correct. Well, in order for this collection company to obtain a judgment against you, they must take you to court and win.

If they did but you were not notified about this hearing, you may not have been served correctly which may be grounds for dismissal. If I were you, I would contact the court who ordered the judgment and request a new hearing that you can attend. If this did not answer your question, please re-phrase and I will answer accordingly.
