Marriage and Bankruptcy: Can my finances help my fiance? ***

Postby ValerieNovak on August 1st, 2008, 11:56 pm

My fiance is going through chapter 13 bk it isn't filed yet...

We plan to get married I was wondering if it would help his case if we got married prior to the filing so that he had more obligations meaning he would have a family he was responsible for.

My income is minimal as I am responsible for my 3 children...any suggestions?

Thanks soo very much! I love this blog! Make sure you stumble it!

That’s a good question but unfortunately I am not sure. My first reaction to it would be “possibly” it would help, but again you would alos be part of the bankruptcy which will hinder your credit and your finances as well. Chapter 13 is a repayment plan which does not forgive the debt, your fiance will be paying it back minus some interest over the next few years,…… so showing more liabilities such as additional family members may not be appropriate or beneficial to him or you. I recommend speaking to a qualified bankruptcy attorney in your state before making any decision. If he does not have one, I recommend contacting your local chamber of commerce and ask for a qualified bankruptcy attorney referral in your venue. Many attornies offer free consultations and if you are looking for the attorney to file your bankruptcy; choose wisely because many are not looking after your interests at all.
