Kentucky Wage Garnishment Procedure

Postby JaniceButler on August 1st, 2008, 11:48 pm

I live in the great state of KY a commonwealth state. My problem-my checking & savings accts were just garnished. to collect on a debt well over 15 years old.this debt ws for a automobile that was purchased through a c/u and later repossed an then sold at an auction. according to the papers i rec'd the debt is for only $1700.00 but the interest is ungodly almost 7000.00.yikes! it has been years since i've heard from this collection group n like a bad toothache they'rrrrre back!anyway i didnt respond to the court to request a hearing. I don't want to file bankruptcy if i can help it nor do i want my wages garnished. I kinda feel that will b the next step. MY ? is....after the garnishment on my sav/check accts can another garnishment be place against the same account. would it be logical to try and contact the agency and work out something reasonable.or just wait on the wage garnishment and then appeal /contest ...I thank you 4 taking out the time

My opinion is: I understand you dilemma 100%. This is a classic junk debt. Garnishment laws vary by state and I am not sure about KY, but I do know that most states only allow one garnishment at a time. If other garnishments are ordered; they must wait in line. Since I cant give you a definitive answer regarding the number of simotaneous judgments, you may want to contact an attorney. Try http://www.legaladviceline.com for a definitive answer. One important thing to do is attend the court proceedings if you thought the debt was time barred so you could have challenged it. Now that a judgment was issued and appeal or reversal would be difficult and costly. Also, attending the garnishment hearings would be wise because they determine the amount of the deductions. Here is some info about garnishment proceedings you may find helpful http://www.expert-credit-advice.com/wage_garnish.htm. I dont know your entire financial situation so it’s impossible to advise bankruptcy but it sounds like you should look at all your options carefully.
