Junk debt buyers, can they collect on an expired debt?

Postby AngielenaMuellenberg on August 2nd, 2008, 12:29 am

I have a question about credit card debt? I live in Michigan , and I have three debts from the year 2001. They are trying to collect now, and I am not sure what I should do? I know that the Statute of limitations is 6 years, and well it has been over that. Can they still try to collect, or should I make it know that it has over exceeded the time to do that. :P

In understand. Yes, they can still try to collect. Remember the statute of limitations begins on the date of last activity. If the debt is truly passed the 6 years, they can still keep trying to collect until you advise them in writing that the debt is time barred. Even then they can pursue litigation and the burden of proof will be on your shoulders. It’s a flawed system, what can I say. Good luck to you!
