Illegal Waqge Garnishment Help Me Please!!!!!!

i am pretty sure i am being illegally garnished for a prior debt, i only received a summons form on or around 01-05-08 which stated i had no more tha 45 days to respond to the summons, long story short about 3weeks later i am being garnished. i have never received any type of paper work from the plaintiff-plaintiffs attorney,the court or from my employer (it was for default on a vehicle.). please help me ! thank-you for yor time, john Horton

Due process requires you to be served so that you can defend yourself. There is not much I can do to help other than offer my opinion. I believe you need to contact the judge that ordered the garnishment and request a hearing. If you are unaware of the judge, ask your employer and they must provide this information. Then, when you find the judge and are granted an appeal; make sure you bring any evidence of the date of last activity of the account such as a cleared check or statement. If the debt is past the statute of limitations; you should be able to reverse and dismiss the judgment and reverse the garnishment. It’s also possible you receive funds back from the garnishee.
