Harassing Debt Collectors Calling. What can I do?

Postby Nstevn on August 26th, 2008, 7:12 pm

A few months back I received a call from an attorney/debt collector. The man on the phone was extremely rude and when I asked for time to think about my financial situation, threatened that I only had a limited amount of time and was trying to push me to say that I refuse to pay my debt and stated that if I did that they would continue with legal action.

Worried that I may be taken to court, etc, etc. I finally got him to agree to give me a day or so to think.
He called me the next day. At the time my finances appeared like I would be able to stick to the payment agreement for six months time- and he told me there were no other options. Then once I agreed to pay this one bill for approx. an extra $200 a month for six months. He tells me that he has another bill in my name. So, he forced me into including that and then uping my payment to approx. $400 a month. Well, being the only full-time employed adult in my house with 2 young children and my husband lost his full time job over a year ago and is working for minimum wage no more than 24 hours a week at a local pharmacy- this has of course proven impossible. However, the collector wouldn't allow me to make any other arrangements except a 6 month payment agreement on a two $1200 debts and/or payment in full. I can barely make it month-to-month as is let alone an additional $200 or $400 bill.

Well, all of this aside. Today while at work my supervisor calls me into her office. Telling me that a man from a law firm called today stating that it was a personal matter and that she is my supervisor and that they haven't been able to contact me and that it is a personal matter. But, she told me this man has been calling our Human Resources department to track down my supervisor.

I feel that this is a complete violation of my rights. I know I owe the debt, but I can't pay something if I have nothing to pay it with. I don't think that it is right that the debt collector could call my job and decide to call my human resources dept to get a hold of my supervisor to have her tell me I need to call them.

I did make one payment, but then my husband did not get hours for a couple of weeks which meant I really was stretched above an beyond to meet the daily needs of rent, food, and utilities. Not to mention that my children started school today and I had to purchase school supplies and clothes for them.

I am tired of them harassing me and I have already told them when I have the money I plan to make payments, but I can't guarantee when that will be or how much. But, I am willing to work that out with them if I don't feel pressured. Or even at this stage I'd prefer a wage garnishment- because then I could set it for a very low amount and at least they would be getting paid each month.

Also, I do not want them calling my place of employment or speaking to my supervisor. That is a negative impression and makes me seem as if I am not a good employee if I can't handle my personal life. My personal life and my business life are seperate and I don't need a debt collector joining them in that way.

Can you help me in any way to stop these harassing phone calls?

If you have taken any loan then u have to pay it but one positive thing for you that they just tell you to pay it and do not do it forcefully by any other activity.
