Credit card debt legal problem in north carolina

Postby GlindaWhite on August 2nd, 2008, 12:01 am

If a person owes a credit card debt that has been turned in to the credit bureau what can the law do? I live in North Carolina. Could they take my car and auction it off? The car is not paid for.

If a credit card debt is turned over to a “collection agency” and the information is reported to the “credit bureaus” there are things the collection agency can do, but taking your financed vehicle is NOT one of them. They may take you to court and if they win, they will be awarded a judgment against you and only then could they possibly attach liens on property, levy bank accounts or garnish wages. I recommend you offer a lump sum, or get on a payment plan with them.

@GlindaWhite; they have no power to take my car or other property and auction it, it’s only possible in one way that they get judgment against you and use this judgment to auction your property or something else. I suggest you to hire a counselor and negotiate with creditor on payment processes, reduce your monthly payment and also try to reduce your interest rate.
