Can time barred debts come back and sue me?

Postby equaldebate on August 5th, 2008, 11:20 am

I have three "charge offs" on my credit report that will be 7 years old later this year. I know I can dispute them and have them removed from my credit reports but can they then pursue further even though it has been this long? One is for an apartment. Another is for a credit card and another is for a 1500 dollar cell phone bill. Can they go for judgements? should I work on paying them off? Thank you.

That is an excellent question Steve!

The debts should automatically “fall off” after 7 years IF the creditors/debt collection agencies report accurate information, the problem is; they usually don’t and the debts may not go away so easy. But yes, it is very possible that if you dispute them and it’s been 7 years they will come off. About them pursuing you????…… Anyone can sue anyone anytime for nearly anything.

The flaw in the system is the fact that even if the debts are old and past the statute of limitations, they can still try to sue you. If you don’t defend yourself, you lose and a judgment is born. The statute of limitations varies by agreement and state.

Here is a list of the statutes listed individually: http://www.expert-credit-advice.com/sta ... ations.htm. My opinion is, don’t start paying on them because that will keep them on your credit for an additional 7 years and restart the date of last activity on the statute of limitations for debt collection.
