10 Year Old Debt. Can I be sued?

Postby TammiHarshberger on August 1st, 2008, 11:53 pm

I received a letter for debt collection on a credit card debt from 10 years ago. The letter states that I will be sued if I don't pay it. In Wyoming the statute of limitations is 8 years, can I be sued?

Anyone can sue anyone anytime for nearly anything so my answer is yes, they can sue you and the burden of proof will be on you. If this happens you need to prove the debt is past the statute of limitations and is no longer collectable. In the meantime, you should demand validation and notify the creditor that the debt is time barred. Keep the documentation so if the creditor sues you, you have ammunition and possibly a counter claim.

You can be sued, but if you can prove the debt is time barred, the judge should throw out the case
